Applications are invited from suitably qualified persons for appointment to the office of State Counsel II (Group H (1), Service Commissions Department.
As a member of a team, the State Counsel II assists the Legal Adviser in the provision of legal expertise to the Director of Personnel Administration in the conduct of a variety of less complex matters regarding all areas of responsibility that falls under the remit of the Service Commissions Department, to advise or represent the Service Commissions on various aspects of the Law.
REQUIRED QUALIFICATIONS, EXPERIENCE AND SKILLS
Minimum qualifications:
- LLB and a LEC – Legal Education Certificate
- Admission to practice Law in Trinidad & Tobago
Minimum experience:
- Three (3) years in the practice of law or legal advisory position
- Knowledge of the Laws of Trinidad & Tobago
- Knowledge of legal principles, practices and proceedings
- Knowledge of Government procedures and practices
Skills:
- Good advocacy skills
- Good legal drafting skills
- Good interpersonal skills
SALARY
Group H (I): $25,256 per month

1. Organisational Context
The Service Commissions Department (SCD) exists to support the work of four Service Commissions through the provisions of advice and services with respect to the appointment, promotion, transfer, and discipline of employees within the Service. The Public Service Commission is responsible for the Civil Service, the Fire Service, and the Prison Service; the other three Commissions support a single service area. The Commissions are guided by the principles, and criteria for all of their functions that are laid down in their Regulations. The department supports this by frequently updating, and revising these regulations. The Service Commissions were established to ensure that appointments and similar actions in the Service would be free from political influence by the government of the day. The Service Commissions Department provides services such as publication of opportunities, responding to queries from potential applicants, receipt and processing of applications, selection and recommendation of short-listed candidates, and responding to requests for information by (unsuccessful) candidates. For promotions, training, experience, merit, ability, and relative seniority of all eligible officers are among the criteria considered, along with an assessment through associated promotion examinations. The regulations are also used to guide the process of transfers within the Services. Disciplinary proceedings against officers in the Services (other than the office of Judge in the Judicial and Legal Service) are governed by their respective Regulations. The role of the Commissions in disciplinary matters is that of an independent, and impartial body that receives complaints or allegations of misconduct which have contravened any relevant Codes of Conduct set down by the Employer or which are in breach of any implied terms and conditions of the particular Service.

3. Position Purpose
- As a member of a team, the State Counsel II assists the Legal Adviser in the provision of legal expertise to the Director of Personnel Administration in the conduct of a variety of less complex matters regarding all areas of responsibility that falls under the remit of the Service Commissions Department, to advise or represent the Service Commissions on various aspects of the law.

5. Specific Accountabilities
- Provides legal analysis and advice to the Service Commissions on matters related to issues of promotion, confirmation, transfer, disciplinary action, removal of public officers through the preparation of legal opinions, drafting responses to freedom of information act (FOIA) requests and represents the Department to ensure that decisions are legally and constitutionally sound, to securing positive judgements and limit the occurrence of appeals.
- Reviews accumulated evidence pertaining to disciplinary matters and drafts charges against public officers through researching relevant laws and case law precedence, analysing the Investigating Officer’s report and supporting documentation, to determine the appropriate course of action and decision by the relevant Service Commission.
- Represents the Service Commissions Department before the Public Service Appeal Board, statutory meetings of the various Commissions and meetings with various external stakeholders in instances where there is misconduct in a public office, a public officer has been discriminated against or public officers appeal the decisions and penalties imposed upon them arising out of disciplinary proceedings, via the preparation of oral and written submissions, examination of available evidence and development of arguments to support and defend the outcomes of said disciplinary proceedings.
- Assists the Solicitor General’s Department in the representation of the Service Commissions Department in Court on judicial review matters pertaining to the decision making process of the Commissions, by responding to pre-action protocol letters in order to provide an opportunity to resolve issues early through the exchange of information or to lay the groundwork for the efficient conduct of court proceedings.
- Provides legal advice in the negotiation of routine employment and service provider contracts for the Department by reviewing, analysing and drafting contracts, proposing amendments where necessary and ensuring they are executed in compliance with existing laws and regulations with the intention of assuring the transparency and legality of the process and to protect the interest of the Commissions.
- Provides legal advice on the revision of the Service Commission Regulations through meetings and conferences with key stakeholders for the purpose of identifying deficiencies and the proposal of necessary amendments in accordance with international standards and best practices.
- Facilitates the training of public officers on the procedures pertaining to the disciplinary process, through conducting ongoing workshops and interactive sessions, with the purpose of increasing the capacity and competency of public officers in the investigation of disciplinary matters.

7. Other Working Relationships
- The stakeholder group associated with the State Counsel II is diverse. The position primarily executes legal functions, plays an advisory consultative role and interacts with the various Service Commissions (Public, Police, Teaching, and Judicial and Legal) as required, to build consensus and reach agreements on matters related to issues of promotion, confirmation, transfer, disciplinary action and removal of public officers.. The position corresponds with all levels in the Service Commissions Department so as to obtain the necessary information on which to base informed advice. The position also interacts frequently with the Public Service Appeal Board. The position advises and requests information from all Ministries/Departments in the public service, Solicitor General’s Department, Chief State Solicitor’s Department, National Library and Information System Authority, Regional Health Authorities, Office of the Attorney General Law Library, Parliament (Joint Select Committees), Judiciary, Police, Fire and Prison Services..

- In the preparation of legal opinions, Briefs and representations on behalf of the Service Commissions Department, the incumbent is called upon to perform in a timely, accurate and professional manner while relying on information from internal sources and external bodies that may not be forthcoming. Consequently, the incumbent must be flexible, innovative and willing to go beyond the call of duty to ensure that relevant documents, submissions, Briefs and witnesses, are available for presentation.
- Ensuring that the Commissions operate within the legal framework/jurisdiction: Constitution, Regulations and Court decisions requires the incumbent to persuade the Commissions’ members of legal and constitutional confines in which they operate to avoid costly litigation.

- Autonomously makes decisions with regards to the prioritising and handling of case matters that the incumbent undertakes within the remit of the Commissions and confines of the governing Regulations.
- Collaboratively proposes amendments to legislation and policies for the relevant Commissions on their Service Regulations and the resulting establishment of practices and procedures to assist the Commissions in carrying out their functions.
- Collaboratively develops, coordinates and implements training plans and approaches to educate subordinate staff and Investigating Officers, within the Public Service.
